Film at Lincoln Center, Inc. (“Film at Lincoln Center,” “we,” “us,” or “our”) is committed to protecting the privacy of personal information of the individuals that interact with us on our websites (including both www.filmlinc.org and www.filmcomment.com) (collectively, the “Sites”) or on social media platforms, including subscribers to our newsletters (collectively, the “Services”). Film at Lincoln Center reserves the right to revise this Privacy Policy from time to time—we will note the date on which any updates are made below. We generally collect and process only Personal Information you voluntarily provide to us; however, we may collect certain information automatically when you interact with our Services, as described below. If you choose not to provide us with certain Personal Information, we may be unable to provide you with the information or services you have requested.

We may occasionally disclose Personal Information to third parties—including to affiliated organizations at Lincoln Center and agents or service providers working on our behalf with which we have a contractual relationship—to the extent reasonably necessary to fulfill the purposes listed above, accomplish our legitimate business activities, comply with legal requirements or assert our rights, or for other purposes with your consent. Except as set forth in this Privacy Policy, we do not share your Personal Information with unaffiliated third parties for their own direct marketing purposes unless you otherwise consent to such sharing. We do not sell your Personal Information. 

We may disclose your Personal Information to the following categories of third parties:

  • Service Providers. We may engage third-party vendors to help us administer, manage, provide, and improve our Services or offerings. These may include payment card processors and third-party vendors engaged to analyze the information collected on our websites for marketing purposes.

The security and confidentiality of your Personal Information matters to us. We have technical, administrative, and physical controls in place designed to protect your Personal Information from unauthorized access, use, and disclosure. However, no security measure is ever perfect or impenetrable, so we cannot guarantee the absolute security of such information.

Data Retention 

Depending on the product or service, we will retain your Personal Information for the period reasonably necessary to fulfill the purposes outlined in this Privacy Policy and as otherwise needed to address tax, corporate, compliance, litigation, and other legal rights and obligations.

Data Subject Rights

Depending on your jurisdiction, you may have the right to obtain confirmation that we maintain certain Personal Information relating to you, verify its content, origin, and accuracy, as well as the rights to access, review, port, delete, or withdraw consent to the processing of Personal Information (without affecting the lawfulness of processing based on consent before its withdrawal). If you make such a request, we will investigate and use reasonable efforts to respond to you in a timely manner. Please note that we may need to retain certain Personal Information as required or permitted by applicable law.

You may opt out of certain electronic communications, including informational and promotional communications, by following the instructions in the communication you receive. Opting out of such communications will not impact our ability to send you non-marketing communications, including information about your purchases or changes to our Privacy Policy.

Cross-Border Data Transfer 

We are based in the United States of America. If you are located in a jurisdiction outside of the United States, or certain territories of the United States, these data protection laws may not be considered to provide an adequate level of protection under your local data protection laws. If you are a visitor to the Sites or a subscriber to our newsletter and prefer not to have your Personal Information transferred to the United States, or one of its territories, do not use our Services. 

Minors

These Services are not intended for or directed to, and we do not knowingly collect Personal Information from, individuals under the age of 18, except for certain situations involving special programs, including those promoting the arts and music educational activities. Where we collect information about minors to participate in such activities, we require parental consent and/or involvement to allow minors to participate in such programs, we only collect the Personal Information with parental consent, we do not collect more information than is necessary, and we use such information only in connection with the program.
